Legal
Terms & Conditions
1. The agreement
These terms are between you and Ibrahim Qraiqe, an independent developer based in Norway ("I", "me", "the developer"), and they govern your use of the Mawtini · Palestine iOS application and of this website. By installing or using the app, you accept them. If you do not accept them, please do not use the app.
Use of the app is also governed by the Privacy Policy, which forms part of these terms.
2. Your licence to use the app
You are granted a personal, non-exclusive, non-transferable, revocable licence to install and use Mawtini on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service and Apple's Licensed Application End User Licence Agreement, which applies to this app except where these terms are more generous to you.
The app is licensed to you, not sold.
3. What you may and may not do
You may use Mawtini for personal, educational and non-commercial purposes, freely.
You may not:
- copy, redistribute, resell or sublicense the app itself;
- reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this restriction;
- extract the app's bundled content in bulk in order to republish it as your own dataset or product;
- remove, obscure or alter any attribution, credit or copyright notice;
- use the app or its content in a way that misrepresents the historical record it presents, or that promotes hatred or violence against any people or group.
Quoting, screenshotting and sharing individual village pages — in classrooms, in writing, in conversation, on social media — is welcome and encouraged, with credit to the app and to the underlying sources.
4. Purpose of the app
Mawtini is an educational and commemorative work about the villages and towns of historic Palestine. It presents places as they were recorded in historical sources, on maps traced by hand, together with what those sources say about them.
The app is not a navigational tool, not a survey instrument, and not a legal record of title, boundaries or ownership. Coordinates are derived from historical maps and are approximate by nature. Do not rely on the app for navigation or for any legal, administrative or property purpose.
5. Content, sources and attribution
The app's content is assembled from identified sources, each credited in the app's Acknowledgements screen and on every village page:
| Material | Source | Terms |
|---|---|---|
| Village names, district groupings, hand-traced regional maps | PalestineRemembered.com | Used with attribution for a non-commercial, educational and commemorative purpose. Rights remain with their respective holders. |
| Village histories | Wikipedia | Text under CC BY-SA 4.0. Adaptations within the app remain under that licence. |
| Populations, dates and structured facts | Wikidata | Dedicated to the public domain under CC0 1.0. |
| Typography — Reem Kufi, Changa, Source Serif 4 | Their respective authors | SIL Open Font License 1.1. |
| The anthem Mawtini | Words by Ibrahim Tuqan; music by Mohammed Flayfel | A work of the shared cultural heritage of the region, included as such and credited to its authors. |
Some village histories in the app are adaptations of Wikipedia text. Where you reuse them, the CC BY-SA 4.0 licence and its attribution and share-alike conditions travel with the text. Every village page carries a "Learn more" link to the source it came from.
If you hold rights in any material used in this app and believe it has been included incorrectly or without proper attribution, please write to mawtini@qraiqe.no. I will correct the attribution or remove the material promptly.
6. Accuracy of historical content
Great care has gone into the content. Histories are matched to villages only where the Arabic name agrees; where a source could not be confirmed, the app deliberately shows no history rather than a plausible guess; and a modern settlement built on a village's land is never permitted to supply that village's story.
Even so, the sources themselves disagree in places, transliterations vary, and errors are possible. The content is provided for education and remembrance, not as an authoritative or legal historical record. Corrections are genuinely welcome and are acted on — see Support.
7. Intellectual property
The app's software, interface design, artwork, game mechanics, written copy and the Mawtini · Palestine name and icon are the property of the developer, except for third-party material listed in section 5, which remains the property of its respective owners. Nothing in these terms transfers ownership of anything to you.
8. Images you share
The app can generate a shareable image of a village or a badge. Those images are created on your device and are yours to share. By sharing one you take responsibility for where you post it and for complying with the terms of whatever service you post it to. Please keep the attribution that appears on the image intact.
9. Third-party links and services
The app and this site link to services I do not control — the App Store, PalestineRemembered.com, Wikipedia, Wikidata. I am not responsible for their content, their availability or their practices, and their own terms and privacy policies apply once you reach them.
10. Availability and changes
The app is provided as it is, and may be updated, changed or withdrawn from sale at any time. Content updates may add villages, add or amend histories, and correct errors. Features may be added or removed between versions. I do not guarantee that any particular feature will remain available indefinitely.
These terms may be revised; the current version is always published on this page with its effective date. Continuing to use the app after a revision means you accept it.
11. No warranty
To the fullest extent permitted by law, the app and this website are provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. I do not warrant that the app will be uninterrupted, error-free, or free of defects, or that its content is complete or correct.
12. Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental, special or consequential loss, or for loss of data, arising from your use of or inability to use the app. My total liability in connection with the app is limited to the amount you paid for it, if anything.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your mandatory statutory rights — including those under Norwegian and EU/EEA consumer law — are unaffected by these terms.
13. Apple
Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide any maintenance or support for it. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, which may refund the purchase price if any; beyond that, Apple has no other warranty obligation with respect to the app. Any claim relating to the app's possession or use — including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or privacy law — is my responsibility and not Apple's. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Termination
Your licence ends automatically if you breach these terms, and ends whenever you delete the app. You may stop using the app at any time, and delete your data as described in Your Privacy Choices.
15. Governing law
These terms are governed by Norwegian law, without regard to its conflict-of-law rules, and disputes fall to the Norwegian courts. If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings there.
